290C Casey Tarmacadam Mares Hurdle & The Stewards fined Mr. D.M. Fogarty, €130 for lodging a passport in respect of Benefique in which the vaccinations did not conform with the provisions of Rule 91. The Stewards allowed the horse to run on receipt of the trainer’s written assurance that the vaccinations were in order.

289A Irish Stallion Farms European Breeders Fund Fillies Maiden & The Stewards informed A. Oliver, trainer of Britain’s Pride (GB), that his charge would have to be re-certified before being declared to run from stalls again. (not as previously published).
Punchestown Meeting, 6th November 2012
363C www.punchestown.com For Betting Value Handicap Steeplechase & The Stewards enquired into possible interference approaching the final fence involving the winner Highdownhill (NZ), ridden by N.P. Madden, Harpsy Cord, ridden by A.E. Lynch, placed second, and Ardglen, ridden by B. Hayes, placed third.
Evidence was heard from the riders concerned.
Having viewed a recording of the race and considered the evidence, the Stewards made no alteration to the Judge’s placings. However, they were of the opinion that both N.P. Madden and A.E. Lynch had ridden carelessly (Rule 214).
Having considered their respective records, the Stewards severely cautioned them concerning their future responsibilities in this regard.
363D Vote In The Childrens Referendum On 10th November Maiden Hurdle & R.J. Jones, rider of Ballyspellan Lad, trained by Miss M.M. Gannon, reported to the Stewards' Secretaries that his mount stumbled independently turning into the straight.
363E Panoramic Restaurant Handicap & A.E. Lynch, rider of Two Euro Luck, trained by M. McDonagh, reported to the Clerk of Scales that his mount hung in running in this race.
363G Go Racing In Kildare Mares Flat Race & Anthony John Black, trainer of Victors Girl, reported to the Office of the Governing Bodies on Wednesday 7th November that his charge choked in running and was to undergo a wind operation today.
Fairyhouse Meeting, 7th November 2012
The Stewards fined the following trainer in respect of his non-runner:-
Gordon Elliott, trainer of Shrapnel (Withdrawn by Order of the Stewards – passport irregularity) - €130.
The Stewards authorised the following substitution of rider at this meeting:
D.N. Russell replaced P. Carberry on Benevolent, trained by Noel Meade (Race 4) Intended mount a non runner.
302A Fairyhouse Maiden Hurdle & The Stewards enquired into the running and riding of Wingtips (FR), ridden by B.J. Cooper, and trained by A.J. Martin.
Evidence was heard from the trainer and rider concerned.
In his evidence B.J. Cooper stated that his instructions were to settle his mount third or fourth, while getting some cover and to try not to hit the front too soon. He added that when the race unfolded in the straight, the leaders quickened from the front and he found himself stuck behind horses. When he attempted to switch to the outside his mount suffered interference, which contributed to him making a mistake at the final hurdle. He said the horse then stayed on well to the line and was possibly an unlucky loser.
In his evidence A.J. Martin confirmed the instructions and added that he was satisfied with the ride. He concluded by saying that the horse was very unlucky and circumstances just went against him.
The Stewards also received a report from the Turf Club Veterinary Officer which stated that Wingtips (FR) was found to be post race normal. Samples were taken for analysis.
Having viewed a recording of the race and considered the evidence, the Stewards noted the explanations offered.
M.P. Walsh, rider of Classic Event trained by Edward P. Harty, reported to the Stewards' Secretaries that his mount ran green in the early stages before staying on well at the finish.
302B Fairyhouse Premier Jump Racing Weekend Handicap & Miss G. Ryan, rider of Glenstar trained by John Patrick Ryan, reported to the Clerk of Scales that her mount suffered interference and that she lost a stirrup iron as a result. She also reported that she thought the horse was unsound and therefore pulled him up approaching the hurdle past the stands.
302C Follow Fairyhouse On Twitter Hurdle & The Stewards enquired into the running and riding of Dancing Tornado, ridden by J.S. McGarvey, and trained by Michael Hourigan.
Evidence was heard from the trainer and rider concerned.
In his evidence J.S. McGarvey stated that his instructions were to drop the horse out, sit as long as he could and not hit the front too soon. He added that the slow early pace meant that as the race unfolded he found himself further back than ideal. He concluded by saying that if he rode the race again he might have finished a few lengths closer, but that he had achieved his best possible place.
In his evidence Michael Hourigan confirmed the instructions and added that he would have preferred to see the horse ridden closer to the slow pace. He also said that the horse is a quirky type who can not hit the front too soon.
The Stewards also received a report from the Turf Club Veterinary Officer which stated that Dancing Tornado was found to be post race normal.
Having viewed a recording of the race and considered the evidence, the Stewards noted the explanations offered.
302E Fairyhouse Follow Us On Facebook Handicap Hurdle & The Stewards requested a report from John C. McConnell, trainer of the winner Lady Olwyn, regarding the apparent improvement in form of his charge compared with the horse’s recent form.
Mr McConnell reported that his charge weakened very quickly at Tramore last time. He added that the animal has a wind problem and that perhaps the very testing conditions at Tramore did not help him.
Having considered the report, the Stewards noted the explanations offered.
Thurles Meeting, 8th November 2012
The Stewards authorised the following nomination and substitution of rider at this meeting:-
A.P. Heskin replaced J.R. Barry on Our Best, trained by W.J. Burke (Race 4) Injured.
303A Cashel (Colts & Geldings) Maiden Hurdle & The Stewards interviewed Ross O’Sullivan, trainer of Popmurphy (GB), regarding the late withdrawal (at 1.44 pm) of his charge citing ground conditions as his reason.
Evidence was heard from the trainer concerned, who stated that his charge is a decent type of horse which has encountered many leg problems in the past. He said that, having consulted with N.P. Madden, rider, and having walked part of the track with him, he was of the opinion that the ground was perfectly described as yielding but was possibly on the faster side in places. However, he said he did not want to risk any injury to the animal and withdrew him as a precaution.
Evidence was also heard from Lorcan Wyer, Turf Club Clerk of the Course.
Having considered the evidence, the Stewards were of the opinion that Ross O’Sullivan had made a valid case but had left it very late to make the withdrawal and they therefore severely cautioned him concerning his future responsibility in this regard.
Mr J. Rearden, Acting Steward, absented himself from this enquiry.
The Turf Club Veterinary Officer examined Dale Street, trained by D.T. Hughes, at the request of the Stewards and reported the animal to have a burst blood vessel post race.
Andrew J. McNamara, rider of Absolute Heretic (AUS), trained by T.J. Taaffe, reported to the Stewards' Secretaries that his mount was settled at the rear to help him get the trip but, he weakened in the closing stages.
303B Templemore Mares Maiden Hurdle & A. Ring, rider of Cheap As Chips, trained by P.J. Rothwell, reported to the Stewards' Secretaries that his mount was free in the early stages and ran very green throughout.
303C Holycross Handicap Hurdle & The Stewards interviewed T.C. Carroll, rider of Speed Dial (GB), concerning his use of the whip in the latter stages of this race.
Evidence was heard from the rider concerned.
Having viewed a recording of the race and considered the evidence, the Stewards were satisfied that T.C. Carroll was in breach of R10(4) in that he failed to give his mount a chance to respond.
Having taken his recent record in this regard into account, the Stewards therefore suspended him for three race days (22nd, 24th, and 25th November).
303D John Meagher Memorial Steeplechase & P. Townend, rider of Ballinahow Lady, trained by David M. O’Brien, reported to the Stewards' Secretaries that his mount could not go the early pace and jumped indifferently when racing on her own.
303G Toboradora Flat Race & Mr R.P. Quinlan, rider of Thornfield, trained by Desmond McDonogh, reported to the Stewards' Secretaries that his mount gurgled badly when pressure was applied about four furlongs out and that he eased the horse thereafter.
Dundalk Meeting, 9th November 2012
304A Irish Stallion Farms European Breeders Fund Maiden & The Stewards interviewed S. Foley, rider of In Salutem (GB), concerning his use of the whip in the closing stages of this race.
Evidence was heard from the rider concerned.
Having viewed a recording of the race and considered the evidence, the Stewards were of the opinion that S. Foley was in breach of R10(3)(g) in that he had used his whip with his arm above shoulder height.
Having taken his very good previous record in this regard into account, the Stewards therefore cautioned him.
304B(i) Crowne Plaza Hotel Race & Stay Handicap (Division One) & William J. Fitzpatrick, trainer of Luckiest Owners, reported to the Office of the Governing Bodies on Monday 12th November that his charge was bumped and hampered on the approach to the straight and hung left thereafter.
304B(ii) Crowne Plaza Hotel Race & Stay Handicap (Division Two) & The Stewards interviewed M.A. Cleere, rider of Doonard Prince, concerning his use of the whip in the closing stages of this race.
Evidence was heard from the rider concerned.
Having viewed a recording of the race and considered the evidence, the Stewards were of the opinion that he was in breach of R10 (3) (g) in that he had used his whip with his arm above shoulder height.
Having taken his recent record in this regard into account, the Stewards therefore suspended him for two race days (23rd and 30th November).
W304C(i) Christmas Party Nights At Dundalk Stadium Handicap (Division One) & The Stewards interviewed M.A. Cleere, rider of Pesdivo, concerning his use of the whip in the closing stages of this race when out of contention.
Evidence was heard from the rider concerned.
Having viewed a recording of the race and considered the evidence, the Stewards were of the opinion that M.A. Cleere was in breach of R10 (3) (b) in that he continued to use his whip after his chance of winning or being place was clearly gone.
Having taken his recent record and an earlier suspension at this meeting into account, the Stewards therefore suspended him for two race days (7th and 12th December).
The Turf Club Veterinary Officer examined Knights Templar, trained by Patrick J. Flynn, at the request of the Stewards and reported the animal to be post race normal.
304C(ii) Christmas Party Nights At Dundalk Stadium Handicap (Division Two) & J.P. Murtagh, rider of Ferryview Place (GB), trained by Eoin Griffin, reported to the Stewards' Secretaries that his mount met with slight interference in the straight but failed to quicken when asked for his effort.
Naas Meeting, 10th November 2012
The Stewards fined the following trainer in respect of his non-runner:-

305C Arkle 50 Years Anniversary Beginners Steeplechase & The Stewards granted permission for fence number eight to be omitted from this race and from the Thoroughbred County Novice Handicap Steeplechases in the interest of safety due to ground conditions.
The Turf Club Veterinary Officer examined Teelin Star, trained by P. Hughes, at the request of the Stewards and reported the animal to be post race normal.
Mr C.J. Sweeney, rider of Teelin Star trained by P. Hughes, reported to the Clerk of Scales that his mount did not handle today’s ground.
The Turf Club Veterinary Officer examined Moscow Chief, trained by C. Byrnes, at the request of the Stewards and reported the animal to be post race normal.
305F Thoroughbred County Novice Handicap Steeplechase & The Stewards requested a report from P.J. Rothwell, trainer of the winner Saoirse Dun, regarding the apparent improvement in form of his charge compared with the horse’s recent form.
Ms R. Lawlor, Authorised representative for P.J. Rothwell, reported that their charge is an out and out stayer who kept galloping and handled today’s very testing conditions. She added that, in their opinion, this race was a weak contest and that the victory came as a surprise.
Having considered the report, the Stewards noted its content.
Andrew Slattery, trainer of Son Of Moyne, reported to the Clerk of Scales that his charge did not handle today’s ground and was therefore pulled up.
William J. McLernon, trainer of The Mull, reported to the Office of the Governing Bodies on Monday 12th November that his charge did not act on today’s ground.
305G Go Racing In Kildare Membership 2013 (Pro/Am) I.N.H. Flat Race & E.D. Delany, trainer of Aquafortis, reported to the Office of the Governing Bodies on Monday 12th November that his charge was found to have kickback in his throat following an endoscopic examination post race.
Limerick Meeting, 11th November 2012
306B Martinstown Opportunity Maiden Hurdle & B. Hayes, rider of Sammy Black (GER), trained by Anthony Mullins, reported to the Stewards' Secretaries that his mount did not handle today’s ground.
306C Winter Wonderland Maiden Hurdle & The Stewards requested a report from John. J. Walsh, trainer of the winner Steady Ed, regarding the apparent improvement in form of his charge compared with the horse’s previous run at Punchestown on 31st October where he finished last of five finishers and was beaten by 31 lengths in the race won by Jupitor.
John J. Walsh reported that his charge was a staying type of horse that had won a Point to Point over three miles earlier in his career. He added that today’s extremely testing ground conditions had benefitted his charge and this, in his opinion, had brought about today’s improved performance.
Having considered the report, the Stewards noted its content.
306D Newton Abbot Races Handicap Hurdle & The Stewards interviewed H.D. Dunne, rider of Baresi, concerning his use of the whip in the closing stages of this race.
Evidence was heard from the rider concerned.
Having viewed a recording of the race and considered the evidence, the Stewards were of the opinion that the rider was in breach of R10. (3) (f), in that he had used his whip with excessive frequency and R10 (4), in that he had failed to give his mount sufficient time to respond.
Having taken his previous record in this regard into account, the Stewards therefore severely cautioned him for the future.
Navan Meeting, 11th November 2012
307B Lismullen Hurdle & A. E. Lynch, rider of Voler La Vedette, trained by C.A. Murphy, reported to the Stewards' Secretaries that his mount ran flat and never travelled in this race.
The Turf Club Veterinary Officer examined Voler La Vedette, trained by C.A. Murphy, at the request of the Stewards and reported the animal to be post race normal.
307C ‘For Auction’ Novice Hurdle & R. Loughran, rider of Captain Arceus trained by D.T. Hughes, reported to the Stewards' Secretaries that his mount never travelled in this race.
The Turf Club Veterinary Officer examined Captain Arceus, trained by D.T. Hughes, at the request of the Stewards and reported the animal to be post race normal.
