Turf Club and I.N.H.S. Committee
The Licensing Committee Mrs C. Corballis (in the Chair), Mr M. Morris and Mr J. Patrick Barry met at The Offices of The Turf Club, The Curragh, Co. Kildare on Thursday, 1st November, 2012 and considered a breach of the conditions under which a licence was granted in relation to insurance. A severe warning and a €300 fine was issued to the following Trainer: J.G. Coogan.
C. Roche, trainer of Short Grass, reported to the Office of the Governing Bodies on Tuesday 6th November that his charge has had a wind operation since his last run at Gowran Park on 26th November 2011.
The following trainers were fined €200 each for the non-notification of a Veterinary
Certificate in accordance with the provisions of Rule 194 (v) (vi):- F. Flood for Clash Rebel (stiff) at Fairyhouse on 23rd October; Michael Mulvany for Tohugo (lame) at Navan on 24th October and A. Oliver for Risk Return (stone bruise) at Leopardstown on 27th October.
Galway Meeting, 29th October 2012
293A Corrib Food Products Maiden Hurdle & The Stewards interviewed T.C. Carroll, rider of Caduceus, placed second, concerning his use of the whip in the closing stages of this race.
Evidence was heard from the rider concerned.
Having viewed a recording of the race and considered the evidence, the Stewards were of the opinion that T.C. Carroll was in breach of Regulation 10. (3)(F), in that he had used his whip with excessive frequency and Regulation 10.(4), in that he had failed to give his mount sufficient time to respond.
Having taken his previous record in this regard into account, the Stewards therefore suspended him for two race days (12th and 14th November).
The Stewards enquired into an incident rounding the final bend involving Ancient Days, ridden by M.P. Walsh, placed second, Silver Shuffle, ridden by I.J. McCarthy, placed third, and Sam Da Vinci (GER), ridden by D.E. Mullins, placed fourth, where it appeared that Silver Shuffle stumbled.
Evidence was heard from the riders concerned.
Having viewed a recording of the race and considered the evidence, the Stewards were of the opinion that the incident was accidental in nature and they therefore took no further action.
293B cancercarewest.ie Mares Maiden Hurdle & M.P. Walsh, rider of Ross Bay, trained by C. Roche, reported to the Stewards' Secretaries that his mount had nothing left approaching the last hurdle where the horse made a made mistake and weakened quickly.
293D www.swordsecurity.com (Q.R) Race & Dermot Anthony McLoughlin, trainer of Tortueuse, reported to the Office of the Governing Bodies on Thursday 1st November that his charge was badly struck into and was also found to have a lung infection following an endoscopic examination post race.
293E W.B. Gavin & Co. European Breeders Fund Beginners Steeplechase & The Stewards interviewed A.P. Cawley, rider of Letter Of Credit, unplaced, concerning his use of the whip in the closing stages of this race.
Evidence was heard from the rider concerned.
Having viewed a recording of the race and considered the evidence, the Stewards were of the opinion that A.P. Cawley was in breach of Regulation 10(3)(g), in that he had used his whip with the arm above shoulder height.
Having taken his previous record in this regard into account, the Stewards cautioned him as to his future responsibilities in this regard.
T.M. Doyle, rider of The Breathalyser, trained by Patrick Neville, reported to the Stewards' Secretaries that his mount dropped himself out of this race and was therefore pulled up.
293F Ennis Lifts Handicap Steeplechase & The Stewards granted permission for the fourth last fence to be omitted in this race due to the low elevation of the sun.
Naas Meeting, 29th October 2012
294B Murray Spelman Insurance Supporting Kildare GAA Poplar Square Steeplechase & The Stewards granted permission for fence eight to be omitted from this race and from the Weatherbys Ireland GSB Beginners Steeplechase in the interest of safety due to ground conditions.
294E Copper Face Jacks Supporting Kildare GAA Brown Lad Handicap Hurdle & The Turf Club Veterinary Officer examined Leroy Parker at the request of the Stewards and reported the animal to be post race normal.
294F Joe Mallon Motors Supporting Kildare GAA Handicap Hurdle & The Turf Club Veterinary Officer examined Rare Symphony at the request of the Stewards and reported the animal to be blowing hard post race.
294G Ben Dunne GYMS Supporting Kildare GAA (Pro/Am) I.N.H. Flat Race & The Stewards fined Noel Meade, €130 for lodging a passport in respect of Mullaghanoe River in which the vaccinations did not conform with the provisions of Rule 91. The Stewards allowed the horse to run on receipt of the trainer’s written assurance that the vaccinations were in order.
Punchestown Meeting, 31st October 2012
295B 10 Euro Admission To All Non Festival Meetings Maiden Hurdle & B.J. Cooper, rider of Troubled, trained by D.T. Hughes, reported to the Stewards' Secretaries that his mount became very tired on today’s ground and was therefore pulled up.
The Turf Club Veterinary Officer examined Troubled, at the request of the Stewards and reported the animal to have a grazed left hind cannon and a small wound on his left fore cannon.
D.N. Russell, rider of Shattered Dream, trained by Gordon Elliot, reported to the Stewards' Secretaries that his mount hung inwards in this race and became very tired on today’s ground before being pulled up.
The Turf Club Veterinary Officer examined Shattered Dream at the request of the Stewards and reported the animal to be blowing hard post race.
B.J. Geraghty, rider of Ravensbury, trained by Mrs Prunella Dobbs, reported to the Stewards' Secretaries that his mount ran very free and tired on today’s ground before being pulled up.
The Turf Club Veterinary Officer examined Ravensbury, at the request of the Stewards and reported the animal to have a swelling on his chest, but otherwise was found to be post race normal.
295E Ballymore Christmas Fair & Family Fun November Festival Beginners Steeplechase & Mr. S. Cavanagh, rider of Thawmetoesout, trained by John J. Walsh, reported to the Stewards' Secretaries that his mount did not handle today’s ground.
Clonmel Meeting, 1st November 2012
The Stewards authorised the following substitution of rider at this meeting:

296A Cahir Mares Maiden Hurdle & Miss K.J. Harrison, rider of Oh So Sweet, trained by Mrs C. Harrison, reported to the Stewards' Secretaries that her mount lost momentum going out on the final circuit.
296B Cashel Maiden Hurdle & B.T O’Connell, rider of Raven’s Feather, trained by Miss Elizabeth Doyle, reported to the Stewards' Secretaries that his mount did not chase this race early on in a very fast pace. He also reported that his mount only stayed on past tired horses which had been in contention from an early stage.
296C Powerstown Demesne Handicap Hurdle & The Stewards requested a report from Denis Gerard Hogan, trainer of Tyrone Tiger, placed second, regarding the apparent improvement in form of his charge compared with the horse’s recent form.
Mr Hogan reported that he acquired this gelding from another trainer following a prominent run in an I.N.H.S. flat race and subsequently raced him four times prior to today. He claimed that the gelding had his best run in maiden company on good ground and went to Listowel for his first run in a handicap. He added that the ground on that occasion was extremely testing and his charge ran prominently until weakening from four hurdles out. He felt that today’s race was a very weak contest apart from Speed Dial (GB) and the better underfoot conditions were to his horse’s advantage.
Having considered the report, the Stewards noted its content.
A representative of Andrew Lee, trainer of Blindspin (GB), reported to the Stewards' Secretaries that this horse gurgled in running.
296F www.grahamnorris.com Memorial Handicap Hurdle & The Stewards requested a report from Eoin Doyle, trainer of the winner Come To Party, regarding the apparent improvement in form of his charge compared with the horse’s recent run.
Mr Doyle reported that his charge returned to racing at Fairyhouse last week following a break since last May. He thought that the horse became very tired at Fairyhouse, and being a stuffy type of individual, he felt that the run would bring him on but that maybe another run would be required to reach full fitness. However he said the animal surprised him today by winning. He added that both the three mile trip and the underfoot conditions were to the horse’s liking today and that he is rated lower over hurdles than over fences.
Having considered the report the Stewards noted its content.
B.J. Cooper, rider of Caherronaun, trained by D.T. Hughes, reported to the Stewards' Secretaries that his mount weakened very quickly for no obvious reason.
The Turf Club Veterinary Officer examined Caheronaun at the request of the Stewards and reported the animal to be post race normal.
Dundalk Meeting, 2nd November 2012
The Stewards authorised the following substitution of rider at this meeting:
M.M. Monaghan replaced R.J. Doyle on Sprack Burn Bridge, trained by Jason Cairns (Race 2) Unwell.
297A Irish Stallions Farms European Breeders Fund Maiden & F. Lynch, rider of Horseware Express trained by J. Larkin reported to the Clerk of Scales that his mount lost her action in the straight.
J.P. Murtagh rider of Sylvan Mist, trained by Edward Lynam reported to the Stewards' Secretaries that his mount ran very green, hung left and did not get a clear run in the straight.
297B Floodlit Friday Nights At Dundalk Maiden & The Stewards informed Edward Lynam, trainer that Dimitar (USA), that his charge would have to be re-certified before being declared to run from stalls again.
297E(i) Crowne Plaza Leading Jockey & Trainer Championship Handicap (Division One) & J.A. Heffernan, rider of Samollie trained by Garvan Donnelly, reported to the Stewards' Secretaries that his mount did not get a clear run in the straight.
F. Lynch, rider of Alheera trained by Sarah Dawson, reported to the Stewards' Secretaries that his mount did not get a clear run in the straight.
Niall Moran, trainer of Nine Bean Rows, reported to the Stewards' Secretaries that his charge “ran flat” during this race.
297E(ii) Crowne Plaza Leading Jockey & Trainer Championship Handicap (Division Two) & The Stewards enquired into an incident two furlongs from the winning post involving the winner Cristy’s Call, ridden by S.A Gray, Golan Heights, ridden by I. J. Brennan, placed fourth, Fleeting Moment, ridden by A. P. Thornton, and Luaimneach (GB) ridden by M. C. Hussey, both unplaced.
Evidence was heard from the riders concerned in the presence of M.J. Grassick, representing T. Stack, trainer and master of S.A. Gray.
Having viewed a recording of the race and considered the evidence, the Stewards were of the opinion that S.A. Gray was in breach of Rule 214 in that he had ridden carelessly. Having taken his previous record in this regard into account, the Stewards therefore suspended him for two race days (16th and 23rd November).
297F Racing Post Handicap & M. Halford, trainer of Eastern Rules reported to the Stewards' Secretaries that his charge hung very badly in this race.
Down Royal Meeting, 2nd November 2012
298B European Breeders Fund Lough Construction Ltd. Mares Novice Hurdle & The Turf Club Veterinary Officer examined Missunited at the request of the Stewards and reported the animal to be post race normal.
298E Porter & Co. Beginners Steeplechase & The Stewards interviewed P. Carberry, rider of Johannisberger, placed fourth, trained by Noel Meade, concerning his riding close home.
Evidence was heard from the rider concerned who stated that his horse was tired when he made a mistake at the last fence and made a noise in-running, He also said that he was not expecting a challenger on his outside. Johannisberger was examined by the Turf Club Veterinary Officer and found to be post race normal.
Having viewed a recording of the race and the print for third place and considered the evidence, the Stewards found P. Carberry to be in breach of Rule 212 (a) (i) in that he failed to take all reasonable and permissible measures throughout the race to ensure that his horse was given a full opportunity to win or of obtaining the best possible place.
Having taken his record in this regard into account, the Stewards therefore suspended him for five race days and ordered him to forfeit his riding fee.
Mr F. Cahill, Acting Steward, absented himself from this enquiry.
The Stewards enquired into the late notification of Soitoldyou as a non-runner for this race.
Evidence was heard from Tony Mulraney, Weighroom Assistant, who stated that this non-runner was only confirmed by the Turf Club Office at 1.03pm following a query from representatives of betting organisations. It had earlier been withdrawn by the trainer through the dedicated Turf Club Non-Runner Line but had somehow not been transmitted to the course as a non-runner previously by The Turf Club Office though the horse’s withdrawal had been notified by email to betting organisations.
Having considered the evidence, the Stewards referred the matter to the CEO of The Turf Club for further investigation and with a view to a similar situation being avoided.
298G Archie Watson Memorial I.N.H. Flat Race & The Stewards interviewed Mr J.T. Carroll, rider of Isle View, placed second, concerning his use of the whip in this race.
Evidence was heard from the rider concerned.

Cork Meeting, 4th November 2012
The Stewards authorised the following substitutions of riders at this meeting:
A.P. Crowe replaced I.J. McCarthy on Elljapa, trained by S.M. Duffy (Race 4) Injured.
D.N. Russell replaced B.J. Cooper on Tofino Bay, trained by D.T. Hughes (Race 5) Intended mount a non runner.
B.R. Dalton replaced D.E. Splaine on Maid Of Malabar, trained by Edward Stanners (Race 6) Unwell.
The Stewards fined the following trainer in respect of his non-runner: Edmond Kent for Kris Kindle (Withdrawn by Order of the Stewards – passport irregularity) - €200.
The Stewards received a report from David Maher, Turf Club Judge, which stated that the mirror on the winning line was inoperable as the supporting frame was warped. He also said that this matter had been brought to the attention of the Acting Stewards at the previous meeting.
Evidence was heard from Michael O’Neil, Racecourse Manager.
In his evidence Mr O’Neill stated that he had already attended to this matter but an acceptable mirror frame was not in place today and it was currently being sourced. However, he gave an assurance that this matter will be dealt with to the satisfaction of the Judge before the next meeting.
The Stewards noted his assurances and informed Mr O’Neill that the matter would be referred to the Turf Club to liaise with Horse Racing Ireland who are responsible for the Judges equipment.
300B Paddy Power Phone 1800 721 821 European Breeders Fund Novice Hurdle & The Stewards interviewed E.J. O’Connell, rider of Free To Dream, placed fifth, concerning his use of the whip in the closing stages of this race.
Evidence was heard from the rider concerned.
Having viewed a recording of the race and considered the evidence the Stewards were of the opinion that the rider was in breach of Regulation 10(3) (g) in that he had used his whip with the arm above shoulder height.
Having taken his previous record in this regard into account, the Stewards therefore suspended him for one race day (20th November).

300F Paddy Power Handicap Hurdle & A.E. Lynch, rider of The Boat People, trained by Henry de Bromhead, reported to the Stewards' Secretaries that his mount weakened quickly in this race.

B.P. Dawson, rider of Write To Me, trained by J.S. Bolger, reported to the Stewards' Secretaries that his mount was slowly into stride and became detached in the early stages.
M.C. Hussey, rider of Mollsrob, trained by Kieran P. Cotter, reported to the Stewards' Secretaries that his mount did not get a clear run and was forced to check in the straight.
301D Knockaire Stakes & The Stewards enquired into an incident approximately one and half furlongs from the finish involving Coolnagree, ridden by D.P. McDonogh, placed fifth, Joe Eile, ridden by E.J. McNamara, Luisant (GB), ridden by J.P. Murtagh, and Strike Action (GB), ridden by W.M. Lordan, all unplaced.
Evidence was heard from the riders concerned.
Having viewed a recording of the race and considered the evidence, the Stewards found the interference to be accidental in nature and took no further action.

301E Eyrefield Stakes & The Turf Club Veterinary Officer examined Orgilgo Bay at the request of the Stewards and reported the animal to be post race normal.
301G Leopardstown November Handicap & N.G. McCullagh, rider of Citizenship (GB), trained by W.P. Mullins, reported to the Stewards' Secretaries that his mount hung badly right in this race.
