The following trainers were fined €200 in each case for the non-notification of a Veterinary Certificate in accordance with the provisions of Rule 194 (v) (vi):- Mr. M.D. O’Callaghan for Dark Pulse (USA) (lame) at Galway on 10th September and J.G. Coogan for Silver Shuffle (lame) at Listowel on 16th September.
Listowel Meeting, 17th September 2012
The Stewards authorised the following substitution of rider at this meeting: C.D. Hayes replaced K.J. Manning (Stewards permission) on Tamam Namoose, trained by Mr. P.D. Deegan (third race).
253B Feale Handicap & The Stewards interviewed R. Coakley, rider of the winner Jappeli, concerning his use of the whip in the closing stages.
Evidence was heard from the rider concerned and also from Mr. K.J. Condon, trainer and master of R. Coakley.
Having viewed a recording of the race and considered the evidence, the Stewards were of the opinion that R. Coakley was in breach of Regulation 10 3.(f) in that he had used his whip with excessive frequency and they therefore suspended him for two race days (1st and 5th October).
The Turf Club Veterinary Officer reported to the Stewards that Consonance, trained by Mr. Joseph G. Murphy, was found to be post race normal.
C.D. Hayes, rider of Tamam Namoose, trained by Mr. P.D. Deegan, reported to the Stewards' Secretaries that his mount lost his action.
253C Irish Stallion Farms European Breeders Fund Premier Nursery Handicap &
The Stewards informed Mr. K.J. Condon, trainer of Ballyorban, that his charge would have to be re-certified before being declared to run from stalls again.
J.P. O’Brien, rider of Count Of Limonade, trained by Mr. A.P. O’Brien, reported to the Stewards' Secretaries that his mount did not handle today’s ground. The Turf Club Veterinary Officer reported to the Stewards that Count Of Limonade was found to be post race normal.
253D John F. McGuire Novice Steeplechase & The Turf Club Veterinary Officer reported to the Stewards that Sweet My Lord (FR), trained by Mr. W.P. Mullins, was found to be post race normal.
253E I.T.B.A. Fillies Scheme Novice Hurdle & Mr. J.P. Kenny, trainer of Ellaway Rose, reported to the Stewards' Secretaries that his charge was pulled up lame.
253F Cashen Handicap Hurdle & The Stewards requested a report from Mr. Patrick Neville, trainer of the winner Mackey Boy, regarding the apparent improvement in form of his charge compared with the horse’s previous run at Sligo, where he was pulled up.
Mr. Neville reported that he thought this was a nice horse after his maiden hurdle win at Limerick in March. However, he said the horse disappointed in his last two runs, including when tried in blinkers last time. He subsequently gave the horse a short break and turned him out in the field for some time which he feels may have sweetened him up.
Having considered the report, the Stewards noted the explanations offered.
Mr. Edward Stanners, trainer of Maid Of Malabar, reported to the Stewards' Secretaries that his charge did not act on today’s ground.
253G Bank Of Ireland I.N.H. Flat Race & The Stewards interviewed Mr. M. Watson, rider of Forced Kin, unplaced, concerning his use of the whip in the closing stages.
Evidence was heard from the rider concerned.
Having viewed a recording of the race and considered the evidence, the Stewards were of the opinion that Mr. Watson was in breach of Regulation 10 3(g) and 10(4) in that he had used his whip with his arm above shoulder height while failing to give his mount time to respond.
Having taken his record into account, the Stewards therefore cautioned him concerning his future responsibilities in this regard.

254C Irish Stallion Farms European Breeders Fund Fillies Handicap & B.A. Curtis, rider of Ariyfa, trained by Mr. Noel Quinlan (in GB), reported to the Stewards' Secretaries that his mount did not act on today’s ground.
254E Listowel Races Supporters Club Lartigue Hurdle & P. Carberry, rider of Blue Cannon, trained by Mr. Noel Meade, reported to the Stewards' Secretaries that his mount did not act on today’s ground.
D. Lavery, rider of Train Of Thought, trained by Mr. D.K. Weld, reported to the Stewards' Secretaries that his mount weakened quickly on today’s ground and was therefore pulled up.
254F Kerry Petroleum Handicap Steeplechase & The Stewards granted permission for fences number three and six to be omitted from this race in the interest of safety due to ground conditions.
254G Captain Christy Maiden Hurdle & R. Walsh, rider of Dani Catalonia, trained by Mr. W.P. Mullins, reported to the Stewards' Secretaries that his mount attempted to run out in the back straight and struck the running rail.

The Stewards authorised the following substitutions of riders at this meeting: The following rider replaced M.P. Walsh (injured):- D.G. Hogan rode Kylebeg Krystle, trained by Mr. Denis Gerard Hogan (sixth race) and Flemens Forever, trained by Mr. Denis Gerard Hogan (seventh race) and D.E. Mullins rode Faltering Fullback (GB) (reserve), trained by Mr. E. McNamara (fifth race).
The Stewards fined the following trainer €200 in respect of his non-runner: Mr. W.P. Mullins for Pique Sous (FR) (ground conditions).
255A Listowel Arms Hotel European Breeders Fund Maiden & The Stewards enquired into an incident in the straight involving the winner Secret Recipe (GB), ridden by P.J. Smullen, Fortify, ridden by J.A. Heffernan, placed third, and Ballyorban, ridden by S. Foley, placed fourth, after it appeared that interference had taken place.
Evidence was heard from the riders concerned.
Having viewed a recording of the race and considered the evidence, the Stewards were of the opinion that any interference was accidental in nature and they therefore took no further action.
255D Ballygarry House Hotel Novice Hurdle & The Stewards interviewed Mr. C. A. Murphy, trainer, regarding the fact that he failed to lodge a passport for the horse which accompanied his runner Magic Spear into the stable yard.
Evidence was heard from the trainer concerned, who accepted that he had brought the accompanying horse into the stable yard without informing the security officers. The trainer also accepted that he had failed to inform the Turf Club Veterinary Officer or present the passport for this horse, despite being aware that it was his responsibility to do so.
Having considered the evidence, the Stewards referred the matter to the Chief Executive of the Turf Club for further investigation. The Stewards further instructed that the accompanying horse be sent to the Turf Club Veterinary Officer for identification.
255E Guinness Kerry National Handicap Steeplechase & The Stewards requested a report from Mr. E. McNamara, trainer of the winner Faltering Fullback (GB), regarding the apparent improvement in form of his charge compared with the horse’s previous run at Killarney where he finished last of eleven.
The trainer reported that, following the horse’s previous run, the rider reported that this animal may benefit from a longer trip and that appears to have brought about a return to form today.
Having considered the report, the Stewards noted the explanation offered.
P. Carberry, rider of Caduceus, trained by Mr. P. Hughes, reported to the Stewards' Secretaries that his mount made a mistake at the first fence and lost confidence thereafter. The Turf Club Veterinary Officer reported to the Stewards that Caduceus was found to have grazes on his right fore fetlock and right and left hind pastern post race. Samples were taken for analysis.
R. Walsh, rider of Themoonandsixpence, trained by Mr. W.P. Mullins, reported to the Stewards' Secretaries that his mount never travelled and was therefore pulled up.
255G M.S.D. Animal Health Maiden Hurdle & S.G. McDermott, rider of Whatsthecrack Jack, trained by Mr. James Joseph Mangan, reported to the Stewards' Secretaries that his mount lost a shoe on the way to the start of this race.
255H McElliotts Tralee Ltd. Mercedes Benz I.N.H. Flat Race & Mr. T.J. Nagle Jr., trainer of My Silver Cloud, reported to the Office of the Governing Bodies on Friday 19th September that his charge was found to have a respiratory tract infection following an endoscopic examination post race.

Having viewed a recording of the race and considered the evidence, the Stewards were of the opinion that the winner had caused minimal interference, but in doing so, they were satisfied that she had not improved her placing in relation to Lordhighprotector and therefore made no alteration to the Judges’ placings and took no further action.
256C T.P. Walsh Memorial Handicap & The Stewards interviewed R.P. Whelan, rider of the winner Rominintheglomin, concerning his use of the whip in the closing stages when his mount clearly had the race won.
Evidence was heard from the rider concerned.
Having viewed a recording of the race and considered the evidence, the Stewards were of the opinion that R.P. Whelan was in breach of R10(3)(C) in that he had used his whip unnecessarily after his mount clearly had her race won.
Having taken his clean previous record in this regard into account, the Stewards therefore cautioned R.P. Whelan for the future.
The Stewards interviewed C.J. Elliott rider of Crystal Wings, placed second, concerning his use of the whip in the closing stages.
Evidence was heard from the rider concerned in the presence of Mr. J.J. Mangan, representing Mrs John Harrington, Master of C.J. Elliott.
Having viewed a recording of the race and considered the evidence, the Stewards were of the opinion that the rider was in breach of R10(3)(g) in that he had used his whip with his arm above shoulder height.
Having taken his clean previous record in this regard into account, the Stewards therefore cautioned him for the future.
256F Guinness Handicap Hurdle & The Stewards enquired into possible interference in the closing stages of this race involving the winner Lough Ferrib, ridden by D.N. Russell, and Princeton Plains, ridden by A.P. McCoy, placed second.
Evidence was heard from the riders concerned.
Having viewed a recording of the race and considered the evidence, the Stewards made no alteration to the Judge’s placings and took no further action.
The Stewards interviewed I.J. McCarthy, rider of Shamiran, placed third, concerning his use of the whip in the closing stages.
Evidence was heard from the rider concerned.
Having viewed a recording of the race and considered the evidence the Stewards were of the opinion that I.J. McCarthy was in breach of Regulation 10 3(f) in that he had used his whip with excessive frequency and Regulation 10 4 in that he had failed to give his mount time to respond.
Having taken his record in this regard into account, the Stewards therefore suspended him for two race days (5th and 6th October).
256G Ladbrokes Handicap Hurdle & R. Walsh, rider of Bundle Of Fun, trained by Mr. W.P. Mullins, reported to the Stewards' Secretaries that his mount never travelled in this race.
P. Townend, rider of Uponthe Hoof, trained by Mr. T.J. Taaffe, reported to the Stewards' Secretaries that his mount pulled too hard early on and did not handle today’s ground. The Turf Club Veterinary Officer reported to the Stewards that Uponthe Hoof was found to be distressed post race.

Having viewed a recording of the race and considered the evidence, the Stewards were of the opinion that R. Walsh was in breach of Regulation 10 3 (e) in that he made contact with his mount other than down the shoulder or on the hind quarters.
Having taken his record into account, they therefore cautioned him concerning his future responsibilities in this regard.
The Turf Club Veterinary Officer reported to the Stewards that Finger Onthe Pulse, trained by Mr. T.J. Taaffe, was found to be blowing hard post race.
257H John Fletcher Memorial Mares I.N.H. Flat Race & The Stewards enquired into an incident on the turn into the straight involving Gone Wrong, ridden by Mr. M.J. O’Connor, placed third, Quarterpastsix, ridden by Mr. J.T. McNamara, placed fourth, and Kickhams Rakti, ridden by Mr. T. Dowling, placed fifth, after it appeared that interference had taken place.
Evidence was heard from the riders concerned.
Having viewed a recording of the race and considered the evidence, the Stewards were of the opinion that Mr. O’Connor was in breach of Rule 214 in that he had ridden carelessly and they therefore severely cautioned him as to his future behaviour in this regard.

Having taken his record in this regard into account, the Stewards therefore severely cautioned him.
R. Coakley , rider of Jappeli, trained by Mr. K.J. Condon, reported to the Stewards' Secretaries that his mount never travelled on today’s ground.
D.E. Mullins, rider of Pepparpot, trained by Ms. Margaret Mullins, reported to the Stewards' Secretaries that his mount suffered interference in the home straight. The Turf Club Veterinary Officer reported to the Stewards that Pepparpot was found to be post race normal.
259D Denny Cordell Lavarack & Lanwades Stud Fillies Stakes & The Stewards received a report from Mr. J.R. Banahan, Turf Club Starter, who stated that a false start in this race was as a result of the field approaching the tape before he was on the roster, while he also stated that T.C. Carroll, rider of Fearnwood Girl, appeared to be the first rider to put his mount into a canter and anticipate the start.
Evidence was heard from Mr. Banahan and from the rider concerned.
Having viewed a recording of the start and considered the evidence, the Stewards were of the opinion that T.C. Carroll was in breach of Rule 208.
Having taken his record in this regard into account, the Stewards therefore suspended him for four race days (7th, 10th, 12th and 14th October).
P.J. Smullen, rider of Caponata (USA), trained by Mr. D.K. Weld, reported to the Stewards' Secretaries that his mount ran flat in this race. The Turf Club Veterinary Officer reported to the Stewards that Caponata (USA) was found to be post race normal.
The Turf Club Veterinary Officer reported to the Stewards that Alla Speranza (GB), trained by Mr. J.S. Bolger, was found to be post race normal.
259E Paulstown Mares Hurdle & D.E. Mullins, rider of Clarach, trained by Mr. Anthony Mullins, reported to the Stewards' Secretaries that his mount was flat out from early in the straight.
259F Thomastown Maiden Hurdle & D.R. Fox, rider of Beag Beannacht, trained by Mr. Ray Hackett, reported to the Stewards' Secretaries that his mount made a noise, jumped very slowly and never travelled.
E.J. O’Connell, rider of Glenmullen Bridge, reported to the Stewards' Secretaries that his mount hit the first hurdle, jumped and travelled poorly thereafter and was therefore pulled up.
D.J. Condon, rider of Sky Pilot, trained by Ms. Joanna Morgan, reported to the Stewards' Secretaries that his mount likes to race prominently, but could not get to do so today and resented being dropped in.
D.E. Mullins, rider of Oscars Joy, trained by Ms. Margaret Mullins, reported to the Stewards' Secretaries that his mount never travelled in this race. The Turf Club Veterinary Officer reported to the Stewards that Oscars Joy was found to be post race normal. The trainer subsequently reported to the Office of the Governing Bodies on Monday 24th September that her charge was found to be in season post race.
259G Gowran Park Handicap Hurdle & The Stewards interviewed T.E. Doran, rider of Rayhani (USA), unplaced, concerning his use of the whip in the closing stages. Evidence was heard from the rider concerned.
Having viewed a recording of the race and considered the evidence, the Stewards were of the opinion that T.E. Doran was in breach of Regulation 10 3 (b) in that he used his whip when his chance of winning or being placed had clearly gone.
Having taken his inexperience in this regard into account and his good record to date, the Stewards therefore cautioned him accordingly.
Andrew J. McNamara, rider of Red Cert, trained by Mr. T.J. Taaffe, reported to the Stewards' Secretaries that his mount finished lame.
