Mr. Slattery reported that Ucanchoose may not have seen out the six furlong trip at Limerick in June, and then ran at the Curragh over five furlongs, but was not seen to his best effect that day on the very testing ground. He explained that the horse is liable to stiffen up if not kept on the move and that he was left standing in the stalls for a prolonged period due to a delay at the start at Bellewstown last time. He said that this may have caused him to stiffen up and possibly contributed to his subsequent poor run. Today he said he the rider to keep Ucanchoose moving down at the start before loading to prevent him stiffening up and this, coupled with running over his best trip and on the best of the ground, may have brought about any apparent improvement.

Evidence was heard from Mr. Coyle and from D.M. Sweeney.
In his evidence, Mr. Coyle stated that the trainer was given an undertaking that the rider would ride at the correct weight, and so was not prepared for his charge to carry 3lbs overweight.
In his evidence, D.M. Sweeney stated that Mr. Dave Keena, riders agent, informed him of the availability of this spare ride, and that Mr. Keena helped secure this ride and has helped him secure rides in the past. He stated that he gave an undertaking that he would ride at the correct weight, but needed to lose approximately 5lbs to do so. He said that, even though he tried to lose that weight, he was still showing 3lbs overweight at scales.
Having considered all the evidence, the Stewards allowed the withdrawal of Crouching Harry, while they were of the opinion that D.M. Sweeney was in breach of Rule 195 (i) in that failed to weigh out at the correct weight. The Stewards therefore suspended him for seven racedays (8th, 9th, 10th, 12th, 13th, 15th and 16th August 2012).
Furthermore, the Stewards referred the matter to the Chief Executive of the Turf Club for further investigation regarding the role of an agent in booking rides for a 10lb claiming apprentice.

Having viewed a recording of the Start and considered the evidence, the Stewards were satisfied that a fair start had been effected and that the incident was as result of Aves and Pharney Lady both being reluctant to race after the start and causing accidental interference. The Stewards therefore noted the explanations offered and therefore took no further action.
The Stewards interviewed Andrew J. McNamara, rider of Dhushan (GB), trained by Mr. Joseph G. Murphy, regarding his riding in this race.
Evidence was heard from the rider concerned, who stated that this horse ran too free and that he was unable to settle him in the early part of this race. He said that, once headed in the straight, the horse became tired. He said that he was conscious of the fact that this was the horse’s first run over this particular distance and he was reluctant to ask the animal for maximum effort until the latter stages.
Having viewed a recording of the race and considered the evidence, the Stewards noted the explanation offered and reminded the rider to be seen to make more of an effort in future.
