The Appeals Body, Mr. J.R. Craigie (in the Chair), Mr. Michael J. Doyle and Mr. J.O.T. Hughes, met at the Stand House Hotel, The Curragh, Co. Kildare, on Thursday, 5th October, 2006, to consider an appeal lodged by trainer, Mr. J. C. Hayden, trainer of “Daring Spirit”, against the decision of the Acting Stewards at Tipperary on 14th September, 2006, when following the running of the Abbey India, Project 2-y-o Nursery Handicap, “Daring Spirit”, ridden by N.G. McCullagh, having been first past the post was disqualified and placed second for having caused interference to “Giftware”, ridden by F.M. Berry.  Evidence was heard from F.M. Berry, N.G. McCullagh and P. Lafarge, Steward Secretary, and a film of the race was also viewed. 

Having considered the evidence, the Appeals Body dismissed the appeal.

Mr. J. C. Hayden was represented by Mr. Andrew Coonan, Coonan Cawley Solicitors, Mr T.Hogan, trainer of Giftware was represented by Mr Liam Guidera, Frank Ward & Co Solicitors and the case was presented to the Committee by Mr. Brian Price, Wilkinson and Price Solicitors, Naas, Co. Kildare.
