Evidence was heard from Mr Cooper and from K.M. Donoghue.
Mr. Cooper stated that he had booked K.M. Donoghue through his agent, but prior to the closing time for the nomination of riders, K.M. Donoghue informed him that he had opted to ride another horse in the race. K.M. Donoghue acknowledged that he had initially accepted the ride on Total Excitement but had subsequently accepted a ride on another horse, and had given Mr Cooper almost an hour and a half to seek a replacement. Mr Cooper acknowledged this but since the race was a 25 runner conditional riders race, he failed to secure the services of a rider who he has satisfied with before the closing time for nominations.
Having considered the evidence, the Stewards allowed the request of C. Brassil to ride Total Excitement, but severely cautioned K.M. Donoghue under Regulation 3 as to his future responsibilities in this regard.

089A KFM Hunters Steeplechase & The Stewards granted permission for fence three (third last) to be omitted from this race and from the remaining steeplechases at today’s meeting in the interest of safety due to ground conditions.
The Stewards enquired into the running and riding of Shin A Vee, ridden by Mr. D O’Connor, and trained by Denis W. Cullen.
Evidence was heard from the rider and trainer concerned.
In his evidence Mr Cullen stated that his instructions to the rider were to sit fourth or fifth, hunt away and to fill the horse’s lungs with air. He initially thought that perhaps the rider had sat too far out of his ground but he did respect the rider’s judgement. He also noted that the horse does make a noise and was wearing a crossed noseband today.
In his evidence Mr O’Connor stated that, in his opinion, this was the animals best run on this ground and he rode him mindful that he would not handle the extreme conditions, while he also wanted to get the horse home safely. He accepted that he lay a little too far out of his ground but felt that the pacesetters would tire. However, they stayed on as did his mount. He felt it was questionable that had he taken a closer position whether his mount would finish any nearer as the horse had not run for two years. He summarised his ride as an error of judgement.
The Stewards also received a report from the Turf Club Veterinary Officer which stated that the horse was found to be clinically normal post race. Samples were taken for analysis.
Having viewed a recording of the race and considered the evidence, the Stewards noted Mr Cullen’s explanation. In relation to Mr O’Connor, the Stewards were of the opinion that he was in breach of Rule 212 (a)(i) in that he failed to take all reasonable and permissible measures throughout the race to ensure that his horse was given a full opportunity to win or of obtaining the best possible place.

Having considered the report, the Stewards allowed the overweight in this exceptional circumstance and took no further action.
The Stewards interviewed Ms. S.O. Oakes, rider of O’Muircheartaigh, unplaced, concerning her use of the whip in the closing stages of this race.
Evidence was heard from the rider concerned.
Having viewed a recording of the race and considered the evidence, the Stewards were of the opinion that the rider was in breach of R10 (3) (b) in that she had continued to use her whip when her chance of winning or being placed had clearly gone.
Having taken her previous good record in this regard into account and her riding experience, the Stewards therefore suspended her for seven race days (11th, 12th, 13th, 14th, 16th, 17th and 18th May).
