In his evidence Mr Keating stated that this filly had previously refused to race at Leopardstown and subsequently loaded slowly at Roscommon before finishing seventh. On the question of instructions given to the rider, Pat Keating stated that he was not informed of any instructions as given by A.P. O’Brien and therefore could not assist this enquiry any further.
In his evidence J.A. Heffernan stated that he was familiar with this filly from her homework. He added that she can be temperamental and consequently she was loaded into stalls by her own handler. He advised the Stewards that he was instructed to make the filly relax; get her to finish and to do the best he could. He felt in running that the runners were flat out in the back straight and he rode tight to the inside, but his mount was stopped early in the straight and switched out and further out again before staying on to finish third past tired horses. In his opinion he achieved his best possible placing, while also ensuring that the object of the exercise to get the filly relaxed and not to knock her about was achieved.
The Stewards also received a report from the Turf Club Veterinary Officer stating that Just Pretending (USA) was found to be post race normal.
The Stewards informed both persons that A.P. The trainer reported that he did not find any abnormality with this filly following her run at Gowran Park where she disappointed. He said on that occasion his charge was racing for the third time with three week intervals between races. He said that, in hindsight, this lightly framed filly may have trained off by her last run so she was consequently freshened up and returned today after a nine week absence. He felt that this was the only contributing factor to a return to form.
Having considered the report, the Stewards noted its content.

Having considered the report, the Stewards noted its content.
