Arising from the Kilbeggan MJS Building & Development Handicap Steeplechase on 26 July 2024, the matter concerning D E Mullins, rider of Father Jed, was reviewed following his lodging of an appeal. The grounds of the appeal were that Mr Mullins believed he was the only rider who completed the course properly.
The Appeals Body convened on 20 September 2024 to consider the matter, ultimately dismissing the appeal. Additionally, the Appeals Body referred the circumstances surrounding the lodging of the appeal to a Senior Racing Official for further examination.
The Irish Horseracing Regulatory Board (IHRB) thoroughly investigated the matter, including:
- A review of race footage;
- Consideration of statements from the Stipendiary Stewards and Clerk of the Course; and
- A full assessment of the grounds of appeal, the hearing transcripts, and explanations provided by Mr Mullins.
During the investigation, the IHRB noted that Mr Mullins is entitled to lodge an appeal citing the specific grounds and paying his deposit. Mr Mullins outlined his rationale for lodging the appeal and addressed queries regarding his interpretation of the rules relating to bypassing a fence during the race. He expressed frustration with the incident, stating that his actions were motivated by a genuine belief that other riders had not adhered to the proper course.
Mr Mullins also acknowledged the decision of the Appeals Body to dismiss his appeal, accepted its findings, and expressed his willingness to bring the matter to a resolution. Importantly, he assured the IHRB that his actions were not intended to misuse the appeals process but were instead driven by good faith intentions to ensure fairness in racing.
The IHRB has concluded that this matter does not meet the threshold of seriousness to warrant a hearing before a Referrals Committee under Rule 272.
Following the investigation and in light of Mr Mullins' explanation, the IHRB acknowledged Mr Mullins’ cooperation throughout this process, and advised that no further action will be taken in respect of this matter.
