The Referrals Committee, Mr. Peter N. Reynolds (in the chair), Ms. Justice Siobhan Keegan and Dr. Frank Kenny convened at Navan Racecourse on Saturday 4th December, to consider the referral of Paul Kiely (Trainer) in relation to the identification of Councilor Dick which was due to run on 5th March 2021 at Fairyhouse.
On the day, the identity of the horse could not be positively identified from the markings contained in the passport presented which described the horse as a bay and was therefore withdrawn by the Stewards and the matter was referred to the IHRB for further consideration.
At the Referral Hearing, the committee considered a written submission from Mr. Kiely.
In his submission, Mr. Kiely explained that he bought the horse at the Tattersalls August Sale in 2017 and confirmed he was a grey horse. He stated that the microchip was correct and this was confirmed at three Point to Point fixtures which the horse ran at.
Having considered the evidence, the Referrals Committee were satisfied that Mr. Kiely was in breach of Rule 90 and reminded him of his responsibilities to get the passport amended to correct the colour of the horse. They imposed a fine of €350.
