The Appeals Body, Mr. Laurence McFerran (Chairman), Mr. John Murphy and Dr. Paddy Molony convened at the Offices of the Irish Horseracing Regulatory Board on Wednesday, 20th September 2023 to consider the appeal of Jamie Powell (Rider) against the decision of the Raceday Stewards at Galway on Tuesday, 12th September 2023.
Following the running of the Galway Apprentice Handicap, the Raceday Stewards found Mr. Powell, rider of Kermiya, in breach of Rule 214 in that he had ridden carelessly and having considered his record in this regard they suspended him for eight racedays.
The grounds of appeal lodged by Mr. Powell was that the Stewards on the day erred in their decision.
At the Appeal Hearing, oral submissions were made by Mr. Kevin Power, Solicitor, on behalf of Mr. Powell. The Appeals Body also watched a recording of the race.
Mr. Power pointed out that Mr. Powell had waited to get a run for about three furlongs, and as he gradually edged out into a gap to challenge, the eventual winner rolled out in front of him causing minimal interference to the horse on Mr. Powell’s outside.
Having considered the evidence, the Appeals Body were satisfied that Mr. Powell had caused interference and they confirmed that Mr. Powell was in breach of Rule 214 in that he had ridden carelessly. Having considered Mr. Powell’s record in this regard, they upheld the decision of the Raceday Stewards to impose a suspension of eight racedays.
