Evidence was heard from the trainer concerned.
In his evidence Mr Fenton stated that he was satisfied with the horse’s first steeplechase start at Thurles. He said that he then took the horse to Gowran Park for another steeplechase, but the animal made a bad mistake early in the race and became detached. The trainer stated that he was unhappy with the horse’s level of performance after making that mistake and so he ran him back quickly at Thurles five days later when the animal jumped carefully throughout on heavy ground.
Following on from this he said that he sought to improve his horse’s jumping through schooling, but in the days prior to his Limerick run on 28th December, he fell while schooling. He added that the race at Limerick was run in extreme conditions and that the horse ran disappointingly before falling at the last and being remounted. He stated that the horse has been extensively schooled since then. He concluded by stating that any apparent improvement today was as a result of the horse jumping better on more suitable ground conditions and in what may have been a weaker race.
Evidence was also heard from Noel O’Brien, Senior Turf Club National Hunt Handicapper, who evaluated the improvement in form for the Stewards. Mr O’Brien stated that this was a 136 rated hurdler which had performed poorly in his steeplechases to date and that today’s performance represented a significant improvement in form.

Cork Meeting, 5th January 2013
005C McCarthy Insurance Group Maiden Hurdle & The Stewards held an enquiry to compare the performance of the winner Dalasiri, trained by Sabrina J. Harty and ridden by A.E. Lynch, as against the animals only previous run at Leopardstown on the 27th December where he finished 11th of 17 runners and was beaten 25 lengths by the winner Flaxen Flare.
Andrew Shaw, Turf Club National Hunt Handicapper, stated that in his opinion Dalasiri travelled well at Leopardstown until the second last hurdle where he made a mistake and then got close to the final hurdle. He added that some of the runners at Leopardstown had very good prior form under the Rules of Racing.
A.E. Lynch, who rode the horse on both occasions, stated that he dropped his mount in at Leopardstown as this was his first racecourse appearance and that the animal travelled well in a race run at a good gallop until he dived at the second last hurdle and lost ground. He said that the horse was again not fluent at the final hurdle where he slowed up on the approach, but that he stayed on from that point to the finish. He further added that today he employed a change of tactics and raced his mount in a prominent position.
Sabrina Harty stated that, in her opinion, the horse ran a very good race at Leopardstown, but that he hit the second last hurdle very hard and landed awkwardly, while he was also far from fluent at the final hurdle.
Both the trainer and rider said that they felt the Form Book did not clearly reflect exactly what happened at the final two hurdles.
Chris Gordon, Turf Club Security Officer, also attended this enquiry and stated that he did not have any concerns whatsoever about the betting in this race.
Prior to the conclusion of evidence, the Stewards viewed a recording of the Leopardstown race on the website as the original video footage was unavailable from IRIS.
Having considered the evidence, the Stewards noted the explanations offered. They also felt that the Form Book comment could have been more descriptive and that the Integrity video footage should have been available for this enquiry.
