The animal again disappointed on his third run over hurdles in December 2010, but he came home sound. However, after his first piece of work a number of days later, the horse was found to be lame. The horse was then examined, but the exact nature of the injury was not pinpointed and so they gave the animal a break. Mr O’Grady stated that, following the horse’s break, he ran him in two chases. He said the horse did not jump well in the second of those chases so he decided to go back hurdling with him. That was at Cork on 11th December 2011, but he was again disappointed with the horse’s performance. He said he felt the horse was not going well with a circuit to go, but was satisfied that the rider had done all he could to achieve his best possible placing. While his rider stated afterwards that the horse may benefit from a step up in trip, he felt that, based on the animal’s work at home, that he would have the pace for two miles.
He said that, after that run, he had his charge thoroughly checked out, but nothing untoward showed up. Because of that, he continued with the animal’s normal training regime and galloped him every day in preparation for this race. He said he made numerous entries for his horse over the Christmas period but, but that today’s race was the first one he got into and he felt it was a weak race.
Evidence was also heard from Mr. Andrew Shaw, Turf Club National Hunt Handicapper, who evaluated the form for the Stewards and explained that Clashnabrook today showed a level of improvement that would be considered greater than normal.
Having considered the evidence available today, the Stewards referred the matter to the Chief Executive of The Turf Club for further investigation.

332A Martinstown Opportunity Handicap Steeplechase & The Stewards requested a report from Mr. C.A. Murphy, trainer of the winner Glam Gerry, regarding the apparent improvement in form of his charge compared to the horse’s last run at Fairyhouse.
Mr. Murphy reported that his charge disappointed at Fairyhouse when jumping poorly and failing to get home on the testing ground. He added that the return to better ground  on a course where he has previously won helped the horse to return to form today.
Having considered the report, the Stewards noted the explanations offered.

The Stewards interviewed P.F. Mangan, rider of Noble Commander, unplaced, concerning his use of the whip.
Evidence was heard from the rider concerned, who accepted that he had used his whip unnecessarily after the final fence.
Having viewed a recording of the race and considered the evidence, the Stewards were of the opinion that P.F. Mangan was in breach of Regulation 10 2(b) in that he continued to use the whip when his chance of winning or being placed had clearly gone. The Stewards therefore suspended him for two race days (14th and 15th January).

Limerick Meeting, 29th December 2011

333A Follow LRC on Facebook Maiden Hurdle & The Stewards enquired into the running and riding of Sober Sailor, placed fourth, ridden by N.P. Madden, and trained by Mr A.J. Martin.

Evidence was heard from the rider concerned and from Mr. Michael Cromwell, Authorised Representative for the trainer.
In his evidence N.P. Madden stated that he received his riding instructions by phone from Mr. Martin on his way to this meeting. He stated that he was instructed to drop his mount in, nurse him along, creep into the race and if he had a chance running down the hill and was good enough, he was to have a good go. He said that his mount had run as per instructions and got into a good position on entering the straight. However, having gone wide for a clear run, the horse was forced onto the used ground and hit a flat spot from which he was unable to pick up. He said he did not resort to the whip or very forceful riding in the closing stages and only used his hands and heels as he felt he had attained his best possible placing.
In his evidence Mr. Cromwell stated that Mr. Martin gave the instructions directly to N.P. Madden and he was unaware of their content. The Stewards also received a report from the Turf Club Veterinary Officer stating that Sober Sailor was found to be post race normal and samples were taken for analysis
Having viewed a recording of the race and considered the evidence, the Stewards decided not to proceed any further with this hearing and referred it to the Referrals Committee as Mr. Martin was in breach of Rule 147(v) in that his representative had not been fully informed of the riding instructions.

Evidence was heard from the rider concerned, who stated that that his mount was hanging badly to the right and he quickly hit him three times down the shoulder and twice behind the saddle for corrective purposes. He accepted that he should either have used the whip a lesser number of times or given his mount a chance to respond.
Having viewed a recording of the race and considered the evidence, the Stewards were satisfied that B.T. O’Connell was in breach of R10 (3) in that he failed to give his mount a chance to respond. Having taken the rider’s very good previous record in this regard into account, the Stewards therefore severely cautioned him.
