Referral - Tramore 31st December, 2007.
The Referrals Committee, Dr. Gordon A. Holmes (in the Chair), Mr. P.J.A. O’Connor and Mr. C. Cunningham, met in the Turf Club Offices, The Curragh, Co. Kildare, on Wednesday 6th February, 2008, to consider a referral from the Registrar of the I.N.H.S. Committee. The referral arose because the Acting Stewards at Tramore on 31st December, 2007, held an enquiry into the running of the Newtown Handicap Steeplechase where it appeared that the entire field pulled up with a circuit still left to run. Orlando Kelly, rider of “Deskelly Interiors”, was originally referred to the Turf Club Chief Executive by the Acting Stewards, who in turn referred him to the Registrar of the I.N.H.S. Committee. The Acting Stewards referred Mr. Kelly because he had failed to make himself available to attend the Enquiry on the day.
Evidence was heard from Mr. Orlando Kelly, Professional Jockey, and Mr. Lorcan Wyer, Steward Secretary, and a film of the race was viewed.
Having considered the evidence the Referrals Committee stated that the appropriate penalty for an offence of this nature was fourteen days but under the circumstances they made an exception in this case and imposed a suspension of five days on Orlando Kelly for a breach of Rule 212, having regard to the penalties already imposed on the other riders on the day in question.
