Mr. Bernard Cullinane  /  “North Lodge (GER)”  Referral

The Referrals Committee, Mr. E. Flannery (in the Chair), Mr. P.J.A. O’Connor and Mr. Charles C. Cunningham, met in the Turf Club Offices, The Curragh, Co. Kildare, on Thursday 6th March, 2008, to consider the referral of Mr. Bernard Cullinane by Mr. Denis Egan, Keeper of the Match Book, in respect of the running of “North Lodge (GER)” in the Free to Speak Apprentice Handicap at the Curragh on 2nd September, 2007, and the entry for the same horse in the Derrinstown Stud Apprentice Handicap at Gowran Park on 4th October, 2007, when Mr. Cullinanes name (as Agent for the Net Busters Syndicate) was on the Forfeit List as published in the Irish Racing Calendar of 30th August, 2007.  Under the provisions of Rule 1 (ii) every person whose name has been published in the Unpaid Forfeit List is a disqualified person until the default is cleared and under the provisions of Rule 87 (ii) a horse is not qualified to be entered to run for any race if, and so long as it is in the ownership or part ownership of a disqualified person.

Having considered the evidence from Ms. Cyndi Lennon, Client Accounts Manager, Horse Racing Ireland, the Referrals Committee fined Mr. Cullinane €400 for a breach of Rule 272 and ordered that he pay a further €300 towards Turf Club costs in the case.

The case was presented to the Committee by Mr. Brian Price, Wilkinson & Price Solicitors, Naas, Co. Kildare.
