Mr. W.J. Burke  -  “Thyne Again” Prohibited Substance

Naas 6th January, 2008.

The Referrals Committee, Mr. E. Flannery (in the Chair), Mr. P.J.A. O’Connor and Mr. Charles C. Cunningham, met in the Turf Club Offices, The Curragh, Co. Kildare, on Thursday 6th March, 2008, to consider a report from BHP Laboratories in Limerick that the Biological Fluid Sample taken from “Thyne Again” following its win in the Irish Stallion Farms European Breeders Fund Novice Steeplechase at Naas on 6th January, 2008, was found to contain Procaine which is included in the schedule of Prohibited Substances pursuant to Rule 20 (v) of the Rules of Racing and the Irish National Hunt Steeplechase Rules.  Evidence was heard from Mr. W.J. Burke, Trainer of “Thyne Again”, and Mr. Andrew Tyrrell, Turf Club Veterinary Officer.

Having considered the evidence the Referrals Committee fined Mr. Burke €200 but waived the fine under the provisions of Rule 148 (ii).  They disqualified “Thyne Again” from first place and ordered the result to be amended accordingly, as follows:-

First:  Albanov
Second: Dark Artist
Third:  Freds Benefit
Fourth: Celtic Warrior

The case was presented to the Committee by Mr. Sean Barry, Registrar, I.N.H.S. Committee.
