Mrs. John Harrington / Magical Memoir Appeal

The Appeals Body, (Division Two), Judge Tony Hunt, (in the chair), N.B. Wachman and Sean Barry met in the Turf Club on 7th September 2010 to consider the appeal of Mrs. John Harrington, trainer of Magical Memoir, against the decision of the Stewards at Galway on 28th August 2010 when, following the running of the Anglo Printers Maiden Hurdle, the placing of Magical Memoir, who had originally finished first, was reversed with Days Ahead, who had originally finished second.  In arriving at their decision the Stewards were of the opinion that interference had occurred and that Magical Memoir had improved its placing in relation to Days Ahead as a result of this interference.

The grounds of appeal lodged by Mrs. John Harrington were that the Stewards decision was incorrect.

Evidence was heard from M.J. Bolger, rider Magical Memoir, Mrs. John Harrington, D.N. Russell, rider Days Ahead and Eoin Doyle, trainer Days Ahead.

Having considered the evidence the Appeals Body dismissed the appeal.  However, the Appeals Body felt that there was merit in the appeal and as such refused an application from the Turf Club for costs.  They also ordered that the Appellants deposit be refunded.

The case was presented by Denis Egan, Chief Executive of the Turf Club.  Mrs. John Harrington was represented by Andrew Coonan, Coonan Cawley Solicitors, Naas, Co. Kildare.
