Patrick Coffey (Owner) Appeal - Stable Inspection 6th June 2017

The Appeals Body, Mr. Justice Joseph Finnegan, (in the chair), Robert Dore and N.B. Wachman met at the Turf Club, Curragh, Co. Kildare on Monday, 23rd October 2017 to consider the appeal of Patrick Coffey, Owner, against the severity of the sanction imposed by the Referrals Committee on 26th September 2017 when they found that he was in breach of Rules 272(i) and 273(viii) following a number of issues which came to light during a stable inspection at the Training Establishment of James Coyle on 6th June 2017. As a result, the committee disqualified Patrick Coffey for two years. They also ordered that four horses, namely, Bendigo Too, Dottie Lottie, Joy For Mary and Miss Magoo be restricted from running for 12 months.

The Appeals Body considered a number of submissions from Patrick Coffey in relation to issues concerning the previous hearing and also a submission on the severity of the penalty imposed.

Having considered the submissions, the Appeals Body dismissed the appeal. In dismissing the appeal the Appeals Body found that there was no error in principle in the manner in which the Referrals Committee approached the issue of sanction and that there was nothing included in Mr Coffey’s submission today that indicated why the sanction imposed should be amended. They ordered that the penalties should commence on 30th October 2017. Therefore Mr Coffey is a disqualified person for a two year period from 30th October 2017 to 29th October 2019. They also ordered that Mr Coffey’s appeal deposit be forfeited.
