Michael Darcy Referral – Limerick, 3rd May 2010

The Referrals Committee, Mrs. J.O. Onions (in the chair), J.R. Craigie and P.J.A. O’Connor met at the Turf Club, The Curragh, Co. Kildare on 11th May 2010 to consider the referral of Michael Darcy, rider, by the Stewards at Limerick on 3rd May 2010 following his failure of an alcohol breath test prior to racing.  As a result Michael Darcy was suspended from riding on the day at Limerick and the matter was referred to the Referrals Committee in accordance with the provisions of Rule 14(i)(c).

Evidence was heard from Michael Darcy who admitted the breach of the rule and expressed his sincere remorse over what happened.

The Committee also considered written submissions on Mr. Darcy’s character and work ethic from Paul Flynn and Moses McCabe, trainers.

Having considered the evidence the Committee found Michael Darcy in breach of Rule 278 as the concentration of alcohol in his breath at 42 micrograms exceeded the limit allowed of 35 micrograms per 100 milliliters in breath and as such constitutes a banned substance as defined in the Rules.  Because of the seriousness of the offence he was suspended for 12 racedays (26th, 27th, 28th, 31st May.  1st, 3rd, 4th, 5th, 6th, 7th, 10th, 11th June).
