He added that his mount was off the bridle in the early stages and made a respiratory noise from the third last fence, which got progressively worse, before he stayed on past beaten horses in the straight.
In his evidence Mr. O’Loughlin confirmed the instructions and the fact that the horse had jumped ordinary in the past in point to points. Evidence was heard from the trainer and rider concerned.
In his evidence Mr Lambe stated that this horse had fallen in his four point to point races. He said that the horse made his racecourse debut at Ayr recently when ridden by A.P. McCoy and, having raced prominently in the early stages, he stopped quickly and was well beaten. Today he instructed the rider to drop the horse in towards the rear, take his time and not give the animal his head as he would stop instantly. He was satisfied that the rider carried out his instructions.
In his evidence L.A. McKenna confirmed the instructions and added that his mount made a mistake at the fifth last hurdle. He stated that, having jumped the fourth last and third last hurdles, he changed his hands and hit his mount down the shoulder without getting any response. He concluded by stating that he did as instructed and kept a hold of his horse’s head.
The Stewards also received a report from the Turf Club Veterinary Officer stating that Shanroe Secret was found to be post race normal.
Having viewed a recording of the race and considered the evidence, the Stewards noted the explanations offered. The Stewards also cautioned J.J. Evidence was heard from the Turf Club Veterinary Officer and from the trainer concerned.
In her evidence Ms D’Haese gave a detailed explanation of her findings indicating that these lesions could be contagious.
In his evidence Mr Meade expressed an opinion that the Turf Club Veterinary Officer had erred in her opinion and that the lesions were a combination of warts and scald marks from exercise riders boots rubbing against the skin. He added that in his opinion it was not necessary to lodge a veterinary certificate in accordance with the provisions of Rule 148(v) (a). He subsequently lodged a veterinary certificate from Lisadell Equine Hospital stating that they had not identified or diagnosed a case of ringworm in his establishment in the previous four months.
Having considered the evidence, the Stewards ordered the withdrawal of Benemeade in accordance with the provisions of Rule 148(v)(a).
