Mr. E.M. O’Sullivan, Qualified Rider, Appeal - United Hunt (F) Bartlemy, 15th May, 2016.

 

The Appeals Body (Division Two), N.B. Wachman (in the Chair), Mr. Justice Tony Hunt and N.P. Lambert met at the Turf Club, The Curragh, Co. Kildare, on Tuesday, 24th May, 2016, to consider the appeal of Mr. E.M. O’Sullivan, Qualified Rider, (rider of the winner Dick Darsie) against the decision of the Acting Stewards at the United Hunt (F) Bartlemy Point to Point meeting on 15th May, 2016, following the running of the Maiden Race for 6-y-o upwards.  On that day the Stewards found Mr. E.M. O’Sullivan to be in breach of Regulation 58.3 (f) insofar as he had used his whip with excessive force and frequency.  As a consequence he was suspended for two Point to Point race days.   

The appeal was lodged on the grounds that he did not use his whip improperly or excessively.

Evidence was heard from Mr. E.M. O’Sullivan, Qualified Rider.  Evidence was also heard from Bernard Smullen, Stewards Secretary.  Film of the race was also viewed.

Having considered the evidence and viewed the film of the race the Committee found Mr. E.M. O’Sullivan to be in breach of Regulation 58.3 (f) and dismissed the appeal.  They ordered the suspension of two Point to Point days to remain (Saturday 28th and Sunday 29th May).

The case was presented by Paul Murtagh, Stipendiary Steward.  Kevin Power of Maurice Power Solicitors, Kilmallock, represented Mr. E.M. O’Sullivan.
