The Referrals Committee, Mr. Edward Flannery (in the Chair), Mr. P.J.A. O’Connor and Mrs. J.O. Onions, met at the Turf Club Offices, The Curragh, Co. Kildare, on Tuesday, 21st October, 2008, to consider a referral from the Registrar of the INHS Committee that following receipt of a Laboratory Report from Weatherbys Ireland which stated that the horse which appeared under the name “Lily’s Girl” may not have been the horse which it was represented to be when running in the McCarthy Insurance Group (Pro Am) INH Flat Race at Cork on 6th January, 2007.  Evidence was heard from Miss M.M. Gannon, Trainer, and S.W.D. McIlveen, Turf Club Veterinary Officer, in addition to report from Weatherbys Ireland Laboratory.

Having considered the evidence, the Referrals Committee was satisfied that genuine confusion had arisen and the animal which ran at Cork was not “Lily’s Girl”, but was in fact “Sous Le Nez (GB)” and that the two mares had been confused.  The Committee fined Miss Gannon €300 and ordered that the record should be amended to the effect that “Sous Le Nez (GB)” and not “Lily’s Girl” ran at Cork, 6th January, 2007, in the McCarthy Insurance Group (Pro Am) INH Flat Race.

The case was presented to the Committee by Mr. Conal Boyce of Wilkinson and Price Solicitors, Naas, Co. Kildare.
