Martin Harley / Passive Resistance Referral

The Referrals Committee Dr. Gordon A. Holmes (in the chair), Mr. P.J.A. O’Connor and Mrs. J.O. Onions met at the Stewards Room, Curragh Racecourse, Co. Kildare on 23rd October, 2007 to consider a referral from the Acting Stewards at Clonmel on 5th September when following the running of the Rathronan Maiden the Stewards received a report from M. Harley, rider Passive Resistance, after the winner all right had been announced that he lost his lead bag in running

The Committee considered written evidence from M. Harley and F.K. Langan, Clerk of the Scales.

Having considered the evidence the Committee accepted that M. Harley would have been unable to draw the correct weight and in accordance with the provisions of Rule 231(i) disqualified Passive Resistance from 9th place.

The case was presented by Denis Egan, Keeper of the Matchbook.
