J.A. Berry  -  “Coolpotts” Prohibited Substance

The Referrals Committee, Dr. Gordon A. Holmes (in the Chair), Mrs. J.O. Onions and Mr. J. Powell, met in the Turf Club Offices, The Curragh, Co. Kildare, on Thursday 28th January, 2010, to consider a report from BHP Laboratories in Limerick that the biological fluid sample taken from “Coolpotts” following the horse’s success in the 20% Ticket Discount On Line Beginners Steeplechase at Fairyhouse on 4th November, 2010, was found to contain Phenylbutazone and Oxyphenbutazone,  which under Rule 20 (v) and Regulation R14 are Prohibited Substances. 

Evidence was heard from Mr. J.A. Berry, Trainer, and Mr. S.W.D. McIlveen, Turf Club Veterinary Officer. 

The Committee found that Mr. Berry had met the case very fairly and that every effort had been made on his part to establish how the contamination had occurred.  It had appeared likely that the contamination was accidental.  Taking into account Mr. Berry’s very good record and that there was evidence that his stable was run efficiently, the Committee imposed a fine of €500 on him.  The Committee also disqualified “Coolpotts” from first place and ordered the records be amended to read as follows:-

First:  Cindys Schindler
Second: Benbradagh
Third:  Oran Flyer
Fourth: Good Decision
