The Referrals Committee, Mrs. J.O. Onions (in the chair), Mr. J.R. Craigie and Mr. T.P. Rudd, met in the Stewards Room, Naas Racecourse, Naas, Co Kildare on 25th October 2008 to enquire into the improvement in form of Hearthstead Dream (GB) who won the Fairyhouse Membership 2009 handicap at Fairyhouse on 19th October as opposed to his previous run at Roscommon on 5th  August where he finished 12th of 16 beaten 27 lengths by Mythical Prince.  The Acting Stewards at Fairyhouse were unable to conduct an enquiry on the day as Gordon Elliott; trainer was not present at the meeting and had not nominated an authorized representative in accordance with the provisions of Rule 147 (v).

The Committee considered written evidence from Gordon Elliott and viewed videos of the race together with videos of the horse’s previous run at Roscommon on 5th August.  Having considered the evidence they noted Mr. Elliott’s explanation in relation to the horse’s improvement in form.  However they found Mr. Elliott to be in breach of Rule 147 (v) and fined him €500.       

The Case was presented by Mr. Denis Egan, Chief Executive of the Turf Club.
