The Appeals Body, Division Two, Mr. P.J.A. O’Connor (in the Chair), Mrs. T.K. Cooper and Mrs. J.O. Onions, met at the Stand House Hotel, The Curragh, Co. Kildare, on Tuesday, 23rd January, 2007, to consider an appeal lodged by Professional Jockey, E.F. Power, against the severity of the penalty imposed by the Acting Stewards at Cork on 10th December, when following the running of the O’Connell Transport Stayers Novice Hurdle, the rider was suspended for four days for having used his whip with excessive frequency.  The Stewards also instructed that he attend RACE for one days tuition on the use of the whip. 

Evidence was heard from E.F. Power, rider, M.F. O’Donoghue, Steward Secretary, and a film of the race was also viewed.

Having considered the evidence, the Appeals Body decided to dismiss the Appeal.  They confirmed the four days suspension as follows:-January 25th, 27th, 28th and February 1st, 2007.

The Appeals Body instructed that the rider attend RACE for one days tuition on the use of the whip and that his deposit be returned.

The case was presented to the Committee by Mr. Brian Price, Wilkinson and Price Solicitors, Naas, Co. Kildare.
