The Referrals Committee, Judge Tony Hunt (in the Chair), John G. Moloney and Sean Barry met at the Turf Club, The Curragh, Co. Kildare on 3rd April 2012 to consider a request received from the British Horseracing Authority to reciprocate the disqualification of three years (6th October 2010 to 5th October 2013) imposed on Eamon Tyrrell as a result of an enquiry held into the running and riding of Casela Park (IRE) in the This email address is being protected from spambots. Handicap Stakes at Newcastle on 4th August 2010.  The matter had been referred to the Referrals Committee by Denis Egan, Chief Executive of the Turf Club under the provisions of Rule 274(i) and had been adjourned following an initial hearing on 21st March 2011.

The Committee considered a number of legal submissions made by Conal Boyce and Andrew Coonan.

The Committee, having received the referral and being satisfied that the disqualification was imposed by a foreign authority with whom the Turf Club had a reciprocal arrangement, and that all appeal avenues in the UK were exhausted, permitted the respondent to invoke Regulation R18 by way of challenge to the application to reciprocate, but required that particulars of that response be furnished. They gave leave to Andrew Coonan to set out why he believed that the sanction should not apply in Ireland on the basis that the principles of natural justice were not complied with by the British Horseracing Authority in the procedure leading to the sanction.  They asked that these submissions be made by 4th May and ordered that the hearing reconvene on Monday, 21st May 2012 at 10am.
