The Appeals Body, Division Two, Mr. J.R. Craigie (in the Chair), Mr. C.E. O’Sullivan and Mrs. T.K. Cooper, met at the Stand House Hotel, The Curragh, Co. Kildare, on Friday, 9th November, 2007, to consider appeals lodged by Mr. Sam Thompson, Owner of “Breeze Out (GB)”, and Mr. Mark Beecher, Rider of “Breeze Out (GB)”, winner, against the decision of the Acting Stewards when following the running of the Maiden Race for seven and eight year old geldings at Dungarvan on Sunday, 28th October, 2007, “Breeze Out (GB)” was disqualified following a Stewards Enquiry into possible interference and an objection from Mr. B.J. Foley, rider of “Midnight Run”, second, against Mr. Beecher for allegedly striking “Midnight Run” across the face from the turn into the last fence.

Having considered evidence from the two riders, from Mr. Michael Long, spectator on the day, from Mr. Bernard Smullen, Steward Secretary on duty, and having viewed a commercial film of the race, the Appeals Body allowed the Appeals and ordered that the result be amended accordingly, as follows:-

First:  Breeze Out (GB)
Second: Midnight Run
Third:  Ballydoyle Warrior

The case was presented to the Committee by Mr. Brian Price, Wilkinson and Price Solicitors, Naas, Co. Kildare, and Mr. A.R. Coonan of Coonan Cawley Solicitors, Naas, Co. Kildare, represented Mr. Sam Thompson and Mr. Mark Beecher.
