David Russell (Rider) Referral – Clonmel, 29th September 2016

 

The Referrals Committee Sean Barry (in the Chair), Noel McCaffrey and M.C. Hickey met in the Stewards Room, Punchestown Racecourse, Co Kildare on Wednesday, 12th October 2016 to consider the referral of David Russell (rider) by Denis Egan, Chief Executive of the Turf Club. The referral was in respect of David Russell’s refusal to fulfil his final two riding engagements at Clonmel on 29th September 2016 following the conclusion of enquiries into the Kilmore Maiden Hurdle on the day.

Evidence was heard from Dr Adrian McGoldrick, Senior Turf Club Medical Officer and David Russell. The Committee also considered a transcript of the Clonmel enquires which preceded David Russell’s decision not to fulfil his two final riding engagements.

In his evidence Dr McGoldrick gave details of a number of conversations he had with David Russell after the incident, both that day and on the following day.

In his evidence David Russell outlined the background to what occurred leading up to his refusal to fulfil his remaining two riding engagements. He said he deeply regretted his actions and that he had personally apologised to all parties for what he did.

Having considered the evidence, the Committee found David Russell was further in breach of Rule 272 for what occurred and fined him €1,000. In arriving at penalty they took into account his genuine remorse for his actions.
