The Referrals Committee, Philip Caffrey (in the Chair), C.E. O’Sullivan and Mrs. T.K. Cooper met in the Turf Club, The Curragh, Co. Kildare on 9th July to consider a report from Andrew Tyrrell and Mark Carroll, Turf Club Officials, following a visit to the yard of the trainer Andrew Kinsella on 1st June 2010 which revealed that one of the three horses returned in training was not at his premises on the day of the inspection.  The matter had been referred to the Referrals Committee for further consideration by Denis Egan, Chief Executive.

Evidence was heard from Andrew Kinsella, who accepted that he had not returned the horse out of training in accordance with the provisions of Rule 148(vi). He said it was an oversight on his part but that there were mitigating circumstances which he outlined to the Committee and apologised for the omission.

Having considered the evidence, the Committee found Mr. Kinsella guilty of a breach of Rule 148(vi) and imposed a fine of €200.


The case was presented by Denis Egan, Chief Executive of the Turf Club.
